Child
Support
In Texas
parents are expected to support their children. Even in
situations where both parents have "joint custody"
it is common for the court to order one party to make child
support payments.
Some
people believe that this support can be eliminated by agreement
of the parties. In reality, few courts allow this because the
support is designed to ensure the child's best interests are
served.
The Texas
Legislature has set very stringent guidelines for child support
based upon the payor's income. Some courts have even ordered
child support payments based upon what the party should be
earning when there is evidence the party has intentionally taken
a lower paying job for the purpose of decreasing child support
amounts.
Child
support enforcement is available though private attorneys as
well as the Texas Attorney General's office.
If you are
involved in a child support situation which may require court
intervention it is important that you know how the law
specifically affects you. It is unwise to rely on the advice of
friends or co-workers who believe they have all the answers.
